The “Medicare and Medicaid Programs; Emergency Preparedness (EP) Requirements for Medicare and Medicaid Participating Providers and Suppliers” Final Rule establishes national emergency preparedness requirements for participating providers and certified suppliers to plan adequately for both natural and man-made disasters, and coordinate with Federal, state, tribal, regional and local emergency preparedness systems. Seventeen provider types are impacted by the EP Rule to include hospitals, home health agencies, hospices, long-term care facilities and psychiatric residential treatment facilities, though each have different specific requirements. These health care providers rule must comply and implement all regulations one year after the effective date, on November 15, 2017 and thereafter. Compliance with these rules has proven difficult from many providers secondary to a number of reported challenges, to include a lack of knowledge of the detailed rule’s requirements, unreliable transportation contracts, poor collaboration with local emergency management officials and cost.
